These Terms and Conditions are effective as of the date mentioned above in this Terms and Conditions section and will remain in full force and effect unless and until updated or replaced. Your continued use of our website/platform constitutes your ongoing acceptance of these terms, including any modifications made from time to time. Your use of our website/platform constitutes acknowledgment and acceptance of these terms and conditions. 

We reserve the right to update or modify these Terms at any time without prior notice. Your use of our website/platform after any such changes constitutes acceptance of the updated Terms. Pest control providers are contractually required to abide and act accordingly as per these terms and conditions and their future addenda as well. 

Toronto Pest Experts is a registered sole proprietorship owned and operated by Mohit Rajnish Gupta. We can be contacted at contact@torontopestexperts.com or via our Contact Us form for any inquiries or data access requests. Alternatively, we can be contacted via our Mailing Address mentioned at the bottom of this page. DO NOT visit in person – we operate as an online business. 

Welcome to Toronto Pest Experts. By accessing or using our website/platform, you agree with our terms and conditions. You also agree to comply with, and be bound by, the same. Please review them carefully.

The “user” is defined as the party that uses the website and/or fills the “Get A Quote” form or “Contact Us” form. 

1. Introduction:

Toronto Pest Experts operates as a lead generation platform, connecting users with professional pest control service providers in Toronto and the Greater Toronto area. We do not provide pest control services ourselves. We only facilitate the connection between potential clients seeking pest control and licensed pest control providers (read more on our definition of terms like “licensed” below. Hence, We are not a pest control company; we are only a lead generation platform. 

2. No Licensing Requirements for Toronto Pest Experts

As we do not engage in the sale, application, or direct handling of pesticides, Toronto Pest Experts is not required to hold any of the following licenses under Ontario’s Pesticides Act and Ontario Regulation 63/09:

  • Exterminator Licence: Required for individuals who apply or use certain pesticides. Since we do not perform pesticide applications, this license is not applicable to our operations.

  • Operator Licence: Necessary for businesses that employ individuals to apply pesticides commercially, such as pest control companies. As we do not employ exterminators or conduct pest control services, and since we are not a pest control company, we do not need this license. 

  • Vendor Licence: Required for entities that sell, offer to sell, or transfer certain pesticides. Since we do not engage in the sale or distribution of pesticides, this license is not required for our business.

3. Role and Responsibilities

Our role is strictly limited to facilitating connections between users and pest control service providers. WE DO NOT:

  • Guarantee the qualifications, licensing status, or service quality of any pest control provider.

  • Participate in any contractual agreements made between users and pest control providers.

  • Assume responsibility for any disputes or issues arising between users and pest control providers.

Toronto Pest Experts and the third party pest control providers are independent entities. Nothing in the lead generation agreement signed between Toronto Pest Experts and the pest control providers creates a joint venture, partnership, or employment relationship.

While Toronto Pest Experts aims to connect users with pest control providers who are experienced and licensed as required under Ontario law, we do not independently verify or collect licensing credentials. We work with providers who claim to be licensed and have demonstrated reliability. These pest control providers are required to contractually attest that they are fully licensed, fully insured and legally compliant with the regulations and laws of Ontario and those set across Canada, and any other level of law as applicable with regards to the nature of service being provided. They also legally attest to maintaining any municipal business licensing required to operate in Toronto and the GTA. Further they also attest to being compliant with any other permits / licenses / regulations that may be required as per the law at all levels. 

Upon request, all pest control service providers (which our platform connects users to) contractually agree to provide and verify following documentation as applicable. The pest control service providers are to be bound by the following and contractually attest to being compliant with the same:

    • Any municipal business licensing required to operate in Toronto and the GTA. 
    • Valid pesticide licensing and certification as required by Ontario law:
      • Exterminator license: At least one employee of the service provider (usually the technician or owner-operator) must hold a Structural Exterminator License under Ontario’s Pesticides Act and Reg. 63/09. Also, Must pass the Structural Exterminator Certification Exam administered by the Ontario Pesticide Training & Certification Program (OPTCP).
      • Operator license: Pest control company (Service Provider) must obtain an Operator Licence from the Ontario Ministry of the Environment, Conservation and Parks (MECP) if applying pesticides commercially.
    • Active insurance as required:
      • General liability insurance is essential for pesticide use.
      • Pollution liability insurance
      • Workers’ compensation coverage via WSIB registration if applicable
    • Registration with the Workplace Safety and Insurance Board (WSIB) if service provider has employees.
    • Compliance with Ontario Occupational Health and Safety Act (OHSA) requirements, including:
      • Worker training on chemical handling
      • WHMIS compliance
      • Personal protective equipment (PPE) usage
    • Maintain detailed records of:
      • Pesticides used (product name, registration number, concentration, quantity)
      • Date, time, and location of application
      • Certified exterminator involved
      • Note that some activities may require annual reports to the MECP.
    • Federal Regulations (Pesticides):
      • Only use pesticides that are registered with Health Canada’s PMRA.
      • Ensure labels are followed exactly — it’s illegal to apply products in a manner inconsistent with the label.
      • Store and transport pesticides according to Transportation of Dangerous Goods (TDG) regulations, if applicable.
    • Maintain all safety standards as required provincially and/or federally (including but not limited to using industry safe standards for pest control). 
    • Any other permits/licenses/regulations/registrations that may be required as per the law at all levels. Note: For any public facing name deviations from the legal entity name of the business (whether or not for marketing purposes) that may require registrations, the responsibility remains solely with the pest control service provider to ensure legal compliance, and isn’t part of the contractual attestation and is the only exception.

Service providers contractually attest to being fully licensed and fully legally compliant with the regulations and laws of Ontario and those set across Canada, and any other level of law/regulations as applicable, and any exceptions have clearly been outlined. All attestations and legal compliance must be maintained during the course of validity of the contractual lead generation agreement (including agreement extensions) between Toronto Pest Experts and the respective pest control provider – until terminated. Any exceptions have clearly been outlined in these terms and conditions and are coherent with those presented in the lead generation agreement signed between Toronto Pest Experts and the respective pest control provider. 

Hence, all service providers connected through Toronto Pest Experts have attested in writing to their legal compliance (given the exceptions), and ALL of these contractual attestations along with demonstrated reliability are what define the basis of our references to terms like “licensed”, “reliable”, “experts”, “expert”, “professionals”, “pros”, and “trusted” – where all these terms are describing / referring to the pest control providers we connect users with through our platform. Demonstrated reliability includes but is not limited to good google reviews, number of years in business, any possible awards represented on their site (not a necessity), etc.

It is the sole responsibility of pest control providers to ensure they remain compliant with all applicable laws, regulations, and licensing requirements, and are contractually responsible for the same. We (Toronto Pest Experts) only collect the attestations contractually, and we do not independently verify or collect credentials ourselves. 

Toronto Pest Experts relies on service provider attestations and does not independently verify or check the registration of public-facing brand names and their deviations. Where Toronto Pest Experts is made aware of name deviations, the responsibility remains solely with the pest control provider to ensure legal compliance. Prior to the pest control providers signing the attestations, Toronto Pest Experts will do its due diligence by reminding the pest control providers that they must have any public facing brand names (whether or not used for marketing purposes), registered as required legally; however, Toronto Pest Experts will not go in and verify that they have done the needful. For any name deviations, the responsibility remains solely with the pest control service provider to ensure legal compliance, and Toronto Pest Experts is not liable or responsible for the same. Toronto Pest Experts is NOT responsible/liable for any kind of misconduct on the pest control provider’s end regarding applicable permits, licensing, regulations, registrations, name registrations, etc. on all levels of law. All legal accountability for any and all legal compliance responsibility and liability remains with the pest control service providers as specified in each individual contractual lead generation agreement signed between the respective pest control service provider and Toronto Pest Experts. Toronto Pest Experts is not liable and/or responsible for any kind of misconduct, damages, etc. on the pest control service provider’s end. 

Toronto Pest Experts will cease to work with the service providers should Toronto Pest Experts be made aware of any kind of legal non-compliance and/or falsely acknowledged attestations from the pest control providers end (except for the exceptions clearly outlined). 

Further, we strongly encourage users to perform their own due diligence before hiring or engaging with any pest control provider referred through our platform. This includes, but is not limited to, independently verifying and collecting licensing credentials, registration credentials, and permits required by the pest control providers to maintain in order to be legally compliant as required. 

Pest control providers must obtain explicit user consent for any further communication beyond the initial contact once the user has responded. Each pest control provider may attempt contact up to three times total, through a combination of email, phone, or text – in order to establish initial contact with the user. Providers must also comply with PIPEDA and other applicable privacy laws regarding the handling of user information.

Toronto Pest Experts facilitates the connection between users and pest control service providers but does not guarantee that any provider will contact the user or that the user will receive a specific number of quotes as requested. It is the sole responsibility of the pest control providers to initiate communication once a lead is shared with them. While we strive to connect users with providers based on the user’s preference of the number of quotes they wish to receive, the final number of quotes or responses received is subject to our availability of connections with the providers, and the responsiveness, availability, and ability of the providers to deliver a certain service, and not within the control of Toronto Pest Experts.

4. Limitation of Liability

Toronto Pest Experts shall not be held liable for any damages, losses, and/or issues arising from the use of our website and/or from engagements between users and any pest control service providers connected through our platform. Toronto Pest Experts is not liable for any damages caused to the pest control service providers due to the users, and any damages caused to the users due to the pest control service providers. 

Toronto Pest Experts acts solely as a platform to connect users with independent pest control service providers. We do not guarantee, endorse, or warrant the accuracy, completeness, legality, or quality of any information, claims, or representations made by these third-party pest control providers. 

Users acknowledge and agree that Toronto Pest Experts shall not be held responsible or liable for misconduct regarding legal compliance on the pest control service provider’s end, misrepresentation, any kind of misconduct by the pest control service provider, negligence, damages, or failure of service by any pest control service provider. It is the user’s responsibility to conduct their own due diligence and verify all information before engaging any pest control service.

By using this website, users agree to release Toronto Pest Experts from any claims or damages arising out of their interactions with the service providers connected through our platform.

Content on this website may be created using AI tools and is reviewed for accuracy and relevance before publication. All content is curated, published, and owned by Toronto Pest Experts, and is intended solely for use on this website. If you believe any material infringes on your intellectual property rights, please contact us and we will promptly investigate. Toronto Pest Experts is not a pest control company. The content on this website is intended for general informational purposes only and should not be considered professional advice. These plugins are developed and operated by third parties and are subject to their own terms and policies.

We are not responsible for any content, service disruptions, or data practices related to these third-party tools. By using our website, you acknowledge that such tools may be used and that you are solely responsible for reviewing and complying with any applicable third-party terms.

1. Form submission and email policies (direct email), information we collect

1.1. Get A Quote form submissions: By submitting this form, users consent to their information being shared with pest control providers based on their preference for the number of quotes they wish to receive, and our availability. Users consent to be contacted by one or more pest control providers via phone, email, or text — up to a total of 3 contact attempts per provider. After this point, it becomes the user’s responsibility to reach out if needed. Pest control providers are required to obtain user’s explicit consent for any further communication. Users acknowledge that a confirmation email will be sent upon successful form submission. 

1.2. Contact Us form submissions and direct email: When users fill out our Contact Us form or email us directly, we collect personal information such as name, email address, and any additional information you voluntarily provide in your message. This information is used solely for the purpose of responding to your inquiry or concern. We do not use, sell, or share this data with third parties unless legally required or explicitly requested by you. By submitting this form users consent and agree to be contacted by us regarding their request and that they will receive a confirmation email upon submission of this forms.  

1.3. When you (the user) submits a request for pest control services via the “Get A Quote” form, in addition to pest issue information, we collect basic personal information including your name, phone number, email address, and general location  – all to connect you with pest control providers.

2. How We Use Your Information submitted directly to us 
2.1. Your details shared with us through the “Get A Quote” form are shared with one or more pest control providers who may be able to assist with your request.

  • The data is shared with pest control providers based on the number of quotes the user wishes to receive. For example, wanting to receive an exclusive quote means that the provided information is shared only with 1 pest control provider. Wanting to receive 3 quotes means that information provided will be shared with up to 3 providers (based on our availability of providers). Similarly, wanting to receive 2 quotes means that information provided will be shared with up to 2 providers (based on our availability of providers).  

Data is shared via means of secure encrypted email platforms, secure and encrypted text messaging platforms (e.g. WhatsApp), and/or direct phone call. 
2.2. We do not sell, rent, share, or use your information submitted through the “Get A Quote” form for any purpose other than facilitating a connection between you and one or more pest control providers. This connection involves compensation from the providers for the introduction of potential customers (there may be times when there is no compensation as well). We do not retain this data beyond what is necessary to fulfil this connection, and your data is securely stored with us for up to 6 months after which it is securely deleted, unless otherwise required for legal reasons or user consents to longer storage.

2.3. Contact Us form submissions and direct email: When users fill out our Contact Us form or email us directly, we use the information collected (as listed above) to address your issue of concern. This information is used solely for the purpose of responding to your inquiry. We do not use, sell, or share this data with third parties unless legally required or explicitly requested by you. This data is securely stored and is deleted as soon as the query is resolved. This data may be retained for up to 6 months if the user explicitly requests for a pest control quote via this medium of communication, after which data is deleted unless otherwise required for legal reasons or user consents to longer storage.

2.4. Any kind of data shared with us via means of direct email and/or any kind of form submissions through our platform is received by us via a secure and encrypted email platform.  

3. Contact Attempts & Consent
3.1. Each provider may contact you up to a total of three (3) times via any combination of phone, text, or email.
3.2. After this, if no contact has been established yet, the provider must obtain your explicit consent for any further communication.
3.3. Toronto Pest Experts is not responsible for communication beyond the initial introduction once contact is established between the user and the pest control provider. It is sole the responsibility of the provider to obtain your consent and follow all applicable communication regulations for any further contact.

3.4. Within and before the 3 contact attempts are exhausted by a pest control provider, if the user rejects the pest control service provider’s services, the pest control service provider contractually agrees to respect the decision of the user and must not contact them further without their explicit consent. 

3.5. Although pest control providers are contractually required to follow these regulations set out by us, we (Toronto Pest Experts) are not responsible for any breach of contract or misconduct by the pest control providers regarding/with your information.  

4. Compliance & Responsibilities
4.1. Once your information is shared with a pest control provider, Toronto Pest Experts is not responsible for how that provider uses, stores, or secures your data. Pest control providers are contractually required to comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) in handling your information, but it is their sole responsibility to comply. Toronto Pest Experts does not monitor or control the data handling practices of third-party providers and disclaims any liability for misuse, unauthorised disclosure, or breach of information by these providers. 
4.2. If you wish to revoke your consent or request data deletion/correction, please contact us, and we will notify the respective provider(s) promptly, and act accordingly to honour your request at our end.

5. Data Retention
We retain and securely store your information submitted via the “Get A Quote” for up to 6 months after submission in order to support potential follow-ups or service inquiries. After this period, your data is securely permanently deleted unless we are required to retain it longer for legal reasons or the user (you) consent to longer storage. Our data retention and deletion policy is already detailed in clause 2 of this privacy policy. 

Pest control providers which whom user data is shared with must not retain user data beyond 6 months from date of form submission unless acquired explicit consent to do so from the user itself. Upon termination of internal lead contracts with pest control providers, pest control providers must certify deletion of all and any user data shared with them through our platform. This must happen within 10 days of termination. To further detail this, pest control service providers contractually agree to not retain lead data beyond 6 months from date of form submission unless acquired explicit consent to do so from the user itself. Upon termination or expiration of lead generation agreements between Toronto Pest Experts and pest control service providers, the pest control service provider is contractually required to comply with the following with immediate effect:

  • Data Deletion: The pest control service Provider agrees to permanently delete all lead data provided by Toronto Pest Experts from its systems, records, and backups within 10 business days of termination (ensuring not to exceed the 6 month data retention deadline, unless retention is required by applicable law and/or the service provider has obtained explicit consent from the lead to retain their data.
  • No Further Use: The pest control service Provider shall not use, share, or otherwise process any previously provided lead/user data after termination of the lead generation agreement unless the pest control service provider has obtained explicit consent from the user/lead to do so.
  • Liability: The pest control service Provider shall remain liable for any misuse, unauthorized disclosure, breach, or damages involving or related to the leads and/or lead data after termination, and agrees to indemnify Toronto Pest Experts for any claims or damages arising from such misuse and/or actions.
  • Certification of Deletion: The pest control service provider shall confirm in writing to Toronto Pest Experts that all lead data has been deleted as required under this clause. If the Service Provider does not confirm deletion in writing within 10 business days of termination, they will be deemed in breach of contract and may be held liable for any resulting damages or claims.

6. Use of third party website plugins and Tools

We use a range of third-party plugins, tools, and services to operate and improve our website. These may collect and process limited user data, such as IP address, browser type, or on-site behavior, to fulfill their functionality. The following plugins are currently in use:

  • LiteSpeed Cache – Used to optimize site performance through caching. This may involve temporary storage of data such as IP addresses for delivery efficiency.

  • Rank Math SEO – Helps improve search engine visibility. It does not directly collect personal user data.

  • Site Kit by Google – Integrates Google services (such as Google Analytics and Search Console) to help us understand user behavior. Google may collect usage data and cookies as described in their Privacy Policy which can be found online. 

  • WPForms Lite – Enables form submissions. Any personal data submitted through forms (e.g., name, email) is securely stored and not shared with WPForms’ servers in the Lite version.

  • Google Ads and Tracking Technologies: We use Google Ads to promote our services and reach relevant audiences. As part of this, Google may collect data such as IP addresses, browser information, and site interactions through cookies and similar technologies. This data helps us measure ad performance, optimize campaigns, and serve more relevant ads. By using our website, you consent to the use of such advertising tracking technologies as described in our Cookie Policy. You may opt out of personalized advertising by visiting the Google Ads Settings page or using browser-based tools. We do not share personally identifiable information with Google without your consent. For more details on how Google uses your data, refer to Google’s Privacy & Terms.

  • Complianz – Used to facilitate user consent regarding cookies and third party plugins. Our cookie policy is generated with the help of Complianz.
  • Other Website Development tools – used for website development and website hosting purposes.  

These services operate under their own privacy policies and terms of service. We encourage users to review those policies for detailed information. We do not control how third parties handle your data, and are not responsible for the same.

Furthermore, our website uses both functional (necessary) and non-functional cookies. Functional cookies are essential to ensure basic site performance and security. Non-functional cookies, such as those used for analytics or marketing purposes, may be placed by third-party services (e.g., Google, Facebook, etc.). You have the right to accept or reject non-functional cookies at any time through our cookie consent banner. These preferences do not affect your access to core website features.

7. Opt-Out Options

Users have the right to control how their data is collected and used. You may opt out of certain data collection and communication features as described below:

7.1. Google Analytics / Site Kit by Google
We use Google services to analyze website traffic. You can opt out of Google Analytics tracking by navigating to our Cookie Policy. Alternatively, an option would be installing the Google Analytics Opt-out Browser Add-on.

7.2. Marketing Communications
We do not currently send newsletters or promotional emails. If we do in the future, users will have the option to unsubscribe at any time using the “unsubscribe” link provided in the emails.

7.3. Cookies and Tracking Technologies
You have the right to opt out of non-functional cookies and manage other consent settings at any time through our Cookie Policy page. Details are outlined within the Cookie Policy page itself. Alternatively, you may choose to disable cookies through your browser settings. Kindly note, doing any of these actions may affect the functionality of our website, but may not affect core website features. 

7.4. Form Submissions
If you’ve submitted a form and wish to have your data edited, removed or not shared with third-party providers, please contact us directly. We will honour your request as soon as possible.

8. Individual Access:

Users have the full right to request for their personal data being deleted and/or edited. Users have the right to submit complaints or concerns to us regarding privacy issues directly by informing us. Users must contact us directly for any such issues, and we will honour and respond to their request of any such type promptly and as soon as possible.  For any such type of queries described in this section, we try our best to respond within 48h itself; however due to any kind of circumstances, responses may be delayed up to 30 days as well. 

Pest control providers are contractually required to abide by any form of data access, deletion, and/or correction requests by Toronto Pest Experts and/or the user itself (you). We will request certification of deletion of data from pest control providers in cases where you explicitly request for a certificate of data deletion regarding your demand for data to be deleted. We will perform our due diligence for requesting data access, deletion, and or/correction; however, the pest control providers are fully liable for complying with the same. For data deletion certificates, pest control providers are fully liable for providing the same, and Toronto Pest Experts shall not be held liable for cases where responses are negative and/or any such requests are ignored by the pest control service provider.  

Toronto Pest Experts can only exercise the privacy policy with pest control service providers regarding user data shared by Toronto Pest Experts itself, and not any additional data users share directly with the pest control provider. Toronto Pest Experts has no access to any data shared by the user directly to the Pest Control Providers, and hence cannot request any individual access regarding the same. From pest control providers, we can only request access, corrections and deletion of data shared to us by the user – which we share directly with the pest control providers given user consent. That is, information shared via the Get A Quote form, or through other means where the user consents to their data being shared with the pest control providers. Toronto Pest Experts is not to be held liable for any data shared between the user and the pest control providers directly.     

9. PIPEDA Compliance Statement

Toronto Pest Experts is committed to handling all personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). The following outlines our approach to PIPEDA compliance:

9.1. Accountability

We designate a Privacy Officer (the business owner) responsible for ensuring compliance with PIPEDA. We abide by this privacy policy regarding how lead data is collected, used, stored, and deleted. All third-party service providers (pest control companies) we work with are contractually required to comply with the same privacy standards as outlined in this privacy policy.

9.2. Identifying Purposes

We collect personal information solely for the purpose of connecting users with pest control companies. This purpose is clearly communicated at the time of data collection, typically through the “Get A Quote” form. Other purposes for information collection are also outlined in this privacy policy. 

9.3. Consent

We obtain explicit consent from users before sharing their personal information with third-party service providers. Users are informed of how many providers they may be contacted by (typically 1 to 3 depending on their preferences), and by submitting the form, they provide their consent.

9.4. Limiting Collection

We only collect the minimum necessary information to fulfill the lead connection service — including name, contact information, pest issue, and general location. We do not collect sensitive data unrelated to the purpose.

9.5. Limiting Use, Disclosure, and Retention

We use personal information exclusively to match users with pest control providers.

We retain data for a maximum of 6 months unless extended retention is required by law or additional consent is obtained from the user.

Users have the right to access the personal data we hold about them. We try our best to respond within 48h, however response times may be delayed up to 30 days as well.

9.10. Challenging Compliance

Users may raise privacy-related concerns or complaints by contacting us or emailing us at contact@torontopestexperts.com.

If a concern is not resolved, users may escalate the issue to the Office of the Privacy Commissioner of Canada.

10. Information we collect from pest control service providers:

We collect limited business contact information from pest control service providers who partner with us, including names (including their business’s legal name for contractual purposes), business phone numbers, email addresses, and attestations regarding legal compliance (including but not limited to licensing, registrations, etc. – via a lead generation agreement form). Sometimes, business’s may provide extra certifications for credibility, and these certifications are kept securely with Toronto Pest Experts. All of this information is collected and used solely for the purpose of facilitating communication, delivering lead information, issuing invoices, and fulfilling our contractual obligations. By partnering with us, service providers consent to the collection and use of their business-related personal information strictly for these operational purposes. We do not share service provider data with any third parties outside the scope of our business relationship without express consent, and we apply appropriate safeguards to protect this information.

11. Changes to Privacy Policy

We reserve the right to modify this Privacy Policy at any time. The most up to date version is displayed on this page, and your continued use of our platform and services constitutes acceptance of the updated Privacy Policy.
